TAC Impairment Protocol

This is a voluntary protocol under which the lawyers representing the accident victim play a direct role in the assessment of their client’s level of permanent impairment in order to reach agreement with the TAC concerning the impairment lump sum entitlement. Under the protocol the TAC is required to make a contribution towards the client’s legal costs in being represented. The purpose of the protocol was to reduce the number of disputes that arose from assessments made independently by the TAC. The protocol has been successful in achieving proper impairment outcomes faster.
